You should carefully read the following Terms and Conditions. Your purchase or use of our products or services implies that you have read and accepted these Terms and Conditions.

License

ThemeSnap.com grants you non-exclusive limited license to use our themes (CSS, custom theme images and/or graphics) and other products sold through our web site by independent content providers (the "products") in accordance with these Terms and
Conditions (the "license").

What's GPL'd, What Isn't?

Drupal is open source and distributed under the GPL license. Therefore, any Drupal modules and theme files we might create, distribute, or "sell" from ThemeSnap.com fall under Drupal's GPL license. Theme files could consist of, but are not limited to, files that "hook" into Drupal, i.e. the page.tpl, block.tpl, or template.tpl files among others. These files can be distributed freely after your purchase and these are not licensed files created by ThemeSnap.com.

However, the CSS file for our themes are free-standing, independent files that are used by the web browser rather than executed by Drupal. Therefore, this file itself is not governed under the same GPL licensing clause. Further, the output generated by a live Drupal site - including CSS, images, and other media files, as well as Javascript code used by a theme, are NOT automatically released under the same GPL license simply because they are sent from the server to a user's browser.

The image files and the CSS (commonly called "styles.css"), are by definition independent of Drupal. They are not derived from Drupal in any way, and could work just as well on another CMS or even as static HTML or XHTML pages. In fact, all of our themes, CSS, and images, are created first as static XHTML files that are completely independent from Drupal.

Therefore, you must obtain our permission to redistribute the images, media, and CSS files that make our themes distinctive.

Limited Use Granted

You may use each individual product purchased on as many websites as needed as long as the usage is on a website owned nd registered to you, the purchaser. Multiple client website installations are not allowed with our products.

Modifications

You are authorized to make any necessary modification(s) to our products to fit your or your client's purposes.

Unauthorized Use

You may not place any of our products, modified or unmodified, on a diskette, CD, website or any other medium and offer them for redistribution or resale of any kind without prior written consent from ThemeSnap.com.

Assignability

You may not sub-license, assign, or transfer this license to anyone else without prior written consent from ThemeSnap.com.

Ownership

You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of ThemeSnap.com. In particular, you agree to have a discrete link to ThemeSnap.com on the template/website. Our products are provided "as is" without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.

Return Policy

Since our company is offering non-tangible irrevocable goods we do not issue refunds after the product is shipped/downloaded, which you are responsible for understanding upon purchasing. Please make sure that you've carefully read all relevant documentation and tried out the theme demos before purchasing. We only make exceptions with this rule when the product appears to be not-as-described on a case by case basis in agreement of the parties concerned. The deadline for any refund claim is within 7 days after the delivery date.

Controlling Law and Jurisdiction

THIS LICENSE SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NORTH CAROLINA, WITHOUT REGARD TO CONFLICTS OF LAWS PROVISIONS. YOU HEREBY AGREE AND CONSENT THAT THE SOLE AND EXCLUSIVE JURISDICTION FOR ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATING TO THIS LICENSE SHALL BE AN APPROPRIATE STATE OR FEDERAL COURT LOCATED IN THE STATE OF NORTH CAROLINA.

ThemeSnap.com reserves the right to change or modify these Terms at any time with no prior notice.
